Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and 5280 Taxi ("Company," "we," "our," or "us") governing your use of our non-emergency medical transportation services.
By booking, using, or accessing our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our services.
Service Description
5280 Taxi provides non-emergency medical transportation (NEMT) services in Colorado and surrounding states. Our services are designed for individuals who require transportation to and from medical appointments, treatments, and healthcare facilities but do not require emergency medical care.
Services Include:
- Ambulatory transportation for patients who can walk independently
- Wheelchair-accessible transportation with lift-equipped vehicles
- Stretcher transportation for patients who must remain recumbent
- Dialysis transportation with flexible scheduling
- Hospital discharge and admission transportation
- Medical appointment transportation
- Long-distance medical transportation (out-of-state available)
Important: Our services are for non-emergency situations only. If you are experiencing a medical emergency, call 911 immediately.
Eligibility and Requirements
To use our services, you must:
- Be at least 18 years of age, or have a parent/guardian book on your behalf
- Provide accurate and complete information when booking
- Disclose any medical conditions, mobility limitations, or special needs
- Have the ability to pay for services or valid insurance authorization
- Be medically stable and appropriate for non-emergency transportation
We reserve the right to refuse service if we determine that a customer requires emergency medical care or poses a safety risk to themselves, our staff, or other passengers.
Booking and Scheduling
How to Book
Services must be booked in advance by calling (720) 341-5331 or through our website. We recommend booking at least 24-48 hours in advance for non-urgent transportation to ensure availability.
Required Information
When booking, you must provide:
- Passenger name and contact information
- Pickup and drop-off addresses with specific instructions
- Appointment time and any time constraints
- Mobility needs and medical equipment requirements
- Insurance information (if applicable)
- Emergency contact information
Confirmation
You will receive a confirmation via phone, email, or text message with your pickup time, estimated arrival window, and driver information. Please verify all details are correct.
Cancellation and No-Show Policy
Cancellation Policy
Cancellations must be made at least 2 hours before the scheduled pickup time to avoid cancellation fees. You may cancel by phone at (720) 341-5331.
- More than 2 hours notice: No charge
- Less than 2 hours notice: 50% of trip cost
- No-show: 100% of trip cost
No-Show Definition
A no-show occurs when the passenger is not ready or available at the scheduled pickup time and location, or fails to notify us of cancellation. Our drivers will wait up to 15 minutes past the scheduled pickup time.
Exceptions
Cancellation fees may be waived for medical emergencies or circumstances beyond your control. Please contact us to discuss your situation.
Pricing and Payment
Pricing
Pricing is based on multiple factors including:
- Distance traveled (mileage)
- Type of service required (ambulatory, wheelchair, stretcher)
- Special equipment or accommodations needed
- Wait time at appointments (if applicable)
- Time of day and day of week
You will receive a price estimate before confirming your booking. Final charges may vary based on actual mileage, wait time, or additional services provided.
Payment Methods
We accept the following payment methods:
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- Cash (exact change appreciated)
- Insurance (with pre-authorization and verification)
- Medicare/Medicaid (where applicable and authorized)
- Third-party billing (healthcare facilities, case managers)
Payment Terms
Payment is due at the time of service unless prior billing arrangements have been made. For insurance billing, you are responsible for any co-pays, deductibles, or amounts not covered by your insurance.
Late Payment
Unpaid balances are subject to late fees and may be sent to collections. We reserve the right to refuse service to customers with outstanding balances.
Passenger Responsibilities
As a passenger, you agree to the following responsibilities:
- Be Ready: Be ready at the pickup location at the scheduled time
- Accurate Information: Provide complete and accurate information when booking
- Medical Needs: Disclose all relevant medical conditions, mobility limitations, and equipment needs
- Caregiver: Arrange for a caregiver or companion to accompany you if needed for your safety
- Respectful Behavior: Treat drivers and staff with courtesy and respect
- Safety Compliance: Follow all safety instructions, including seatbelt use and wheelchair securement
- Personal Belongings: Keep track of your personal belongings and medical equipment
- Communication: Notify us immediately of any changes to your appointment or transportation needs
Prohibited Conduct
The following behaviors are strictly prohibited and may result in immediate termination of service:
- Threatening, abusive, or violent behavior toward drivers or staff
- Being under the influence of alcohol or illegal drugs
- Smoking or vaping in vehicles
- Bringing weapons or illegal substances
- Damaging company property or vehicles
- Sexual harassment or inappropriate conduct
- Refusing to follow safety instructions
Violations may result in permanent ban from services and potential legal action.
Liability and Insurance
Our Insurance
5280 Taxi maintains comprehensive commercial liability insurance and is fully licensed to operate in Colorado. All vehicles are regularly inspected and maintained to meet safety standards.
Limitation of Liability
While we take every precaution to ensure safe and reliable transportation, we are not liable for:
- Medical emergencies that occur during transport (we will call 911 and provide assistance immediately)
- Delays caused by traffic, weather, road conditions, or other circumstances beyond our control
- Missed appointments due to passenger delays or late readiness
- Personal belongings lost, stolen, or damaged during transport
- Indirect, incidental, or consequential damages
Maximum Liability
Our maximum liability for any claim arising from our services shall not exceed the amount paid for the specific trip in question, except where prohibited by law.
Indemnification
You agree to indemnify and hold harmless 5280 Taxi, its owners, employees, and agents from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any rights of another party.
Privacy and Confidentiality
We are committed to protecting your privacy and maintaining HIPAA compliance. Your personal and medical information will be handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference.
Key Privacy Commitments:
- We will NEVER sell or share your information for marketing purposes
- All staff are trained in HIPAA privacy and security requirements
- Your information is encrypted and securely stored
- You have the right to access, correct, or delete your information
Regulatory Compliance
5280 Taxi complies with all applicable federal, state, and local regulations, including:
- HIPAA: Health Insurance Portability and Accountability Act
- Colorado PUC: Public Utilities Commission regulations
- DOT: Department of Transportation vehicle safety standards
- NEMT Standards: Non-Emergency Medical Transportation industry standards
All drivers are licensed, background-checked, and trained in patient care, safety protocols, and HIPAA compliance.
Service Modifications and Interruptions
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, including:
- Service areas and coverage zones
- Pricing and payment terms
- Vehicle types and availability
- Operating hours and scheduling
We will make reasonable efforts to notify you of significant changes that affect your service. Service interruptions may occur due to maintenance, weather, emergencies, or other unforeseen circumstances.
Dispute Resolution and Governing Law
Informal Resolution
If you have a complaint or dispute, please contact us first at (720) 341-5331 or ali@5280taxi.com. We will work in good faith to resolve the issue promptly.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions.
Jurisdiction
Any legal action or proceeding arising from these Terms shall be brought exclusively in the state or federal courts located in Colorado, and you consent to the jurisdiction of such courts.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and 5280 Taxi regarding the use of our services and supersede all prior agreements and understandings.
Changes to These Terms
We may update these Terms and Conditions from time to time. Material changes will be communicated via email or prominent notice on our website at least 30 days before taking effect.
Continued use of our services after changes are posted constitutes acceptance of the updated Terms. The "Effective Date" at the top of this page indicates when the Terms were last updated.
